Suspension - Termination policy

Brainstorm Solutions reserves the right to suspend or terminate a hosting account for not following the terms of service, non-payment, vulgar language or abuse towards any representative of Brainstorm Solutions. In addition, if you are found making false claims against Brainstorm Solutions, that are unfound, or without evidence, your account may be terminated without notice.

What do we mean by “Account Suspension”?
Account suspension is the temporary closing of an account until an outstanding matter has been resolved. Suspension is typically 48 hours long and is the first step of customer/company mediation. While an account is in suspension status, all of your files, emails, databases, sub-domains, etc. are fully intact. Suspension simply removes account privileges, and public viewing of your pages. Although suspension is typically the first step of the mediation process, this does not mean that your account must be suspended, prior to termination. If a customer’s account is suspended for non-payment, all payments that are due, if any, including suspension fees, must be paid before the account is un-suspended. These payments must be made before the 48 hour deadline, to avoid termination of the account.

What is “Account Termination”?
Account termination is permanent.
An account may be terminated without notice, and without prior suspension. Termination removes all of your files, folders, sub-domains, email addresses, databases, etc. If your account has been terminated by Brainstorm Solutions or by the customer, the customer will be responsible for re-uploading their files, etc, if they choose to have their account turned back on. If a customer’s account is terminated for non-payment, all payments that are due, if any, including termination fees, must be paid before the account is reinstated.

Bandwidth Overage Suspension
Brainstorm Solutions utilizes a term we have called soft data limits. What this means is that we do not suspend your service once you reach your data transfer limit. We also don’t charge you excess data fees. With our service we will allow you to go over your limit. However if you continually go over your data transfer limit Brainstorm Solutions will contact you to discuss your options. Brainstorm Solutions does not believe in penalizing our customers if their website might become popular for a short time. However at the same time we must ensure fair access to our servers for all our customers. Therefore it is Brainstorm Solutions policy that accounts that are unfairly taking up loads on our servers will be suspended and we will contact the owner of the account to discuss options.

Definition of UCE (Unsolicited Commercial E-mail), or SPAM
The bulk delivery of Unsolicited Commercial Email (UCE), promotional material, or other forms of solicitation sent via e-mail that advertise any IP address belonging to Brainstorm Solutions or any URL (domain) that is hosted by Brainstorm Solutions. It also includes unsolicited postings to newsgroups advertising any IP or URL hosted by Brainstorm Solutions. The use of web pages set up on ISPs that allow SPAM-ing (also known as “ghost sites”) that directly or indirectly reference customers to domains or IP addresses hosted by Brainstorm Solutions.
Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to facilitate a means to SPAM. Forging or misrepresenting message headers, whether in whole or in part, to mask the true origin of the message.
